Welcome to Cyber Canni! By using our services, you agree to the following terms of service (“TOS”), which constitute a legal agreement between you and Cyber Canni. If you do not agree to these terms, please do not use our services.

Description of Services

Cyber Canni (owned by Cyber Canni LLC) is an open edition NFT project that allows users to vote on strain creation, packaging, and more. Contingent on the volume of open editions created during the course of the project, we may allow users to burn a set number of NFTs to obtain seeds from the strains that the community votes on. This will also be contingent on shipping laws in your state or country. This is an experiment by nature and nothing about Cyber Canni should be viewed as a financial instrument or investment.

DISCLAIMER: We will not start genetic breeding and “burn to obtain seeds” until the contract programmed timer has been activated within the contract and the mint has closed. Burning for seeds or purchasing any type of cannabis-related product from Cyber Canni should not be undertaken by anyone under the age of 21, as well as by anyone that is unaware of their state or country laws.

1. Introduction

Welcome to Cyber Canni NFT Project (“Cyber Canni,” “we,” or “us”). These Terms of Service (“TOS”) apply to your use of the Cyber Canni website, marketplace, and associated services (collectively, the “Services”). By using the Services, you agree to these TOS, which constitute a binding agreement between you and Cyber Canni/Cyber Canni LLC. If you do not agree to these TOS, do not use the Services.

2. Services

Cyber Canni offers an open edition NFT where users will be able to vote on strain creation, packaging, and more. Contingent on the volume of open editions created during the course of the project, we will allow users to burn a set number of NFTs to obtain seeds from the strains that the community votes on. 3. Intellectual Property

Cyber Canni owns all intellectual property associated with the Services, including the NFTs themselves, the underlying digital assets, and any related content. You may not copy, distribute, modify, or create derivative works based on any Cyber Canni intellectual property without our express written consent.

4. User Conduct

You agree to use the Services only for lawful purposes and in a manner consistent with these TOS. You may not use the Services to engage in any activity that is illegal, fraudulent, or harmful to others. You are responsible for maintaining the confidentiality of your account information, including your login credentials.

5. Fees and Payments

Cyber Canni may charge fees for the use of the Services, such as transaction fees, taxes, shipping, listing fees, or royalties. You agree to pay all fees associated with your use of the Services, and to provide accurate and complete payment information.

6. Disclaimers and Limitations of Liability

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CYBER CANNI DISCLAIMS ALL LIABILITY FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING, WITHOUT LIMITATION, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES. CYBER CANNI’S TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TOS OR YOUR USE OF THE SERVICES SHALL BE LIMITED TO THE AMOUNT YOU HAVE PAID TO CYBER CANNI IN THE PRECEDING 3 MONTHS. We will not start genetic breeding and “burn to obtain seeds” until the time has been activated within the contract and the mint has closed. Burning for seeds or purchasing any type of cannabis related product from Cyber Canni should not be undertaken by anyone under the age of 21, as well as by anyone that is unaware of their state or country laws.

7. Indemnification

You agree to indemnify, defend, and hold harmless Cyber Canni, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorneys’ fees, arising out of or related to your use of the Services or any violation of these TOS.

8. Governing Law and Dispute Resolution

These TOS shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions. Any disputes arising out of or related to these TOS or the Services shall be resolved exclusively through binding arbitration in San Francisco, California, under the rules of the American Arbitration Association. The prevailing party in any such arbitration shall be entitled to recover its reasonable attorneys’ fees and costs.

9. Modifications to the TOS

Cyber Canni may modify these TOS at any time by posting the revised TOS on the Project website or otherwise notifying users of the changes. Users are responsible for reviewing the TOS periodically for any changes. Continued use of the Project after any modifications to the TOS shall constitute acceptance of the modified terms.

10. General

These TOS constitute the entire agreement between Cyber Canni and users regarding the Project, and supersede all prior or contemporaneous communications and proposals, whether oral or written. If any provision of these TOS is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The failure of Cyber Canni to enforce any right or provision of these TOS shall not be deemed a waiver of such right or provision.
